The new year often inspires fresh beginnings, making it an ideal time for aspiring entrepreneurs in the UAE to take the leap and start their dream business. With the UAE’s business-friendly environment, supportive government policies, and strategic location, the country offers ample opportunities for success. Here’s a straightforward guide on how to start a small business in the UAE, with tips and essential legal steps.

1. Decide on your business activity

The first step is to identify the type of business you want to start. The UAE’s Department of Economic Development (DED) offers a comprehensive list of over 2,000 permissible business activities. From e-commerce and food services to consulting and trading, the options are diverse. Your chosen activity will determine the type of license required.

    2. Choose a business structure

Deciding on the business structure is crucial, as it affects ownership, liabilities, and legal requirements. Common options include:

    • Sole proprietorship
    • Limited Liability Company (LLC)
    • Branch of a foreign company

For expatriates, an LLC is a popular choice due to its ability to have 100% foreign ownership in most activities since recent reforms.

    3. Select the right location

The UAE offers two primary options for setting up a business:

Mainland: Provides access to the local UAE market and allows for broader business activities.

Free Zone: Offers tax exemptions, 100% ownership, and simplified processes but limits operations to free zones and international markets unless a distributor is hired.

Research the best option based on your business model and target audience.

    4. Obtain necessary licenses

You must apply for a business license based on your activity and location. Common types include:

    • Commercial License: For trading activities.
    • Professional License: For service-based businesses.
    • Industrial License: For manufacturing businesses.

Submit the required documents, including your passport, visa, trade name approval, and tenancy contract (if applicable).

    5. Register your business

Once your documents are approved, register your business with the DED or the relevant free zone authority. This step includes reserving a trade name, obtaining initial approval, and paying registration fees.

      6. Open a corporate bank account

After business registration, open a corporate bank account in the UAE to manage finances. Choose a bank that offers services aligned with your business needs, such as international transactions, low maintenance fees, or SME-focused banking solutions.

      7. Market your business

Launching your business at the start of the year is a great opportunity to align marketing campaigns with the “new year, new beginnings” sentiment. Use social media, partnerships, and promotions to build awareness and attract customers.

      Tips for success

Plan your finances: Budget for initial setup costs, including licensing fees, office space, and marketing.

Network: Join UAE-based business groups, attend networking events, and engage with other entrepreneurs to build valuable connections.

Stay compliant: Ensure timely renewals of licenses and permits to avoid penalties.

Leverage support: Utilize government initiatives like the Mohammed Bin Rashid Innovation Fund and Dubai SME programs for financial and advisory support.

Starting January 1, 2025, Overseas Filipino Workers (OFWs) contributing to the Social Security System (SSS) will experience changes in their contributions under the updated system. The adjustments aim to strengthen the pension fund’s financial sustainability and align with Republic Act 11199, or the Social Security Act of 2018.

      Key updates for OFWs:

      • The minimum Monthly Salary Credit (MSC) for land-based OFW members will rise to ₱8,000, while the maximum MSC is capped at ₱20,000.
      • Contributions falling between ₱20,000 and ₱35,000 will be allocated to the Mandatory Provident Fund (MPF), allowing members to grow their funds through investments.

      Breakdown of contributions:

      • The updated 15% contribution rate applies to the MSC, with OFWs being responsible for the entire amount as voluntary members.
      • For instance, an OFW with a declared monthly income of ₱20,000 will now contribute ₱3,000 monthly under the SSS program. Any contributions exceeding ₱20,000 will be directed to the MPF.

      ECP inclusion for self-employed members:

Since September 2020, self-employed members, including OFWs, have been included under the Employees’ Compensation Program (ECP), which offers additional protection for work-related contingencies. Employers contribute ₱10 to ₱30 per employee, depending on the MSC, while self-employed members shoulder the ECP contributions themselves.

      Guidance for OFWs:

The SSS advises members who have already prepaid their 2025 contributions to settle any shortfalls to comply with the new minimum MSC. Members are encouraged to review their contributions and take advantage of the investment opportunities under the MPF program.

The Philippine Consulate General in Dubai and the Northern Emirates has released a significant announcement regarding the participation of Filipino overseas voters in the upcoming May 12, 2025, elections. For the first time, registered Filipino voters in the UAE will have the option to cast their votes online for national positions, marking a historic shift towards increasing voter accessibility and turnout.

        Key details on online voting

Filipino overseas voters, specifically those registered at one of the 76 designated posts facilitating online voting, can participate in electing Senators and Party-List Representatives during the 30-day overseas voting period from April 13 to May 12, 2025. The voting will close at 3:00 P.M. UAE Time (7:00 P.M. Philippine Standard Time) on May 12.

To participate, voters must pre-enroll via the COMELEC Voting Portal, which opens on February 27, 2025, and runs until May 12, 2025, before the closing of polls.

        What is online voting?

Online voting allows voters to cast their ballots through the Online Voting and Counting System (OVCS), using any internet-connected device, such as smartphones, laptops, desktops, or tablets, regardless of the operating system. The OVCS is also accessible via standard web browsers like Chrome, Firefox, Safari, or Edge.

For voters facing technological challenges or difficulties, the consulate will provide OVCS kiosks on-site, allowing voters to cast their votes in person from April 13 to May 12 during embassy working hours.

        Pre-enrollment process

To participate, overseas voters must follow these steps:

Access the COMELEC Voting Portal and click the “register to vote” link.

Fill out the required forms and complete the identification process by submitting front and back images of a valid ID and performing a live photo capture.

After validation, voters will receive a confirmation to access the voting portal during the official voting period.

        Test voting & actual voting

COMELEC will offer a test voting platform to help voters familiarize themselves with the process, using test credentials and email/mobile access. When the voting period begins, voters will use the actual voting website to cast their official votes.

This groundbreaking move, in line with Republic Act No. 9189 as amended by Republic Act No. 10590, is expected to significantly increase voter turnout among OFWs by providing more convenient voting methods.

Educators in Dubai’s schools and universities now have the opportunity to secure a prestigious Golden Visa, thanks to a recent announcement by the Knowledge and Human Development Authority (KHDA). This long-term residency is designed to recognize teachers who have made exceptional contributions to the private education sector. Here’s a comprehensive guide to help you understand how to apply for the Golden Visa and the criteria you need to meet.

What is the Golden Visa for educators?

The Golden Visa offers a renewable 10-year residency for qualified educators, allowing them to live and work in Dubai while also sponsoring their family members. This visa is part of an initiative to attract and retain top talent in the education sector.

Who is eligible for the Golden Visa?

Educators from various levels of education in Dubai may be eligible based on their achievements and contributions to raising educational standards. The eligible groups include:

        • Principals and leaders of private schools
        • Managers of private early childhood centers (ECCs)
        • Academic heads of higher education institutions licensed by KHDA
        • Teachers from private schools and ECCs in Dubai
        • Full-time faculty members at KHDA-licensed higher education institutions

Eligibility is determined by factors such as academic achievements, innovation in education, and contributions to student success.

Key steps to apply for a Golden Visa

        1. Nomination by Your Institution

The first step to securing a Golden Visa is being nominated by your school or university. Here’s how the process works:

Talk to your institution’s head: Express your interest in applying for a Golden Visa. They will assess your eligibility and, if you meet the criteria, submit your nomination to the KHDA.

Prepare supporting documents: Depending on your role (teacher, principal, or academic head), you’ll need to submit documents such as award certificates, testimonials, evidence of community work, and proof of student success.

        1. Internal and KHDA Review

        Once your nomination is submitted:

Internal review: Your institution will form a review committee to ensure you meet the Golden Visa requirements.

KHDA submission: If approved by your institution, your application will be submitted to the KHDA for review through their online platform.

KHDA review: The KHDA will evaluate your application and inform you of the outcome.

        1. Apply for the Visa

        Once your nomination is approved:

Submit your visa application: You will receive instructions on how to apply for the Golden Visa through the General Directorate of Residency and Foreigners Affairs (GDRFA) in Dubai.

Cover visa costs: Unless your institution agrees to cover the cost, you will be responsible for the visa fees.

Wait for processing: The visa application process typically takes around 45 working days after all required documents are submitted.

Eligibility Criteria for Principals, ECC Managers, and Academic Heads

For leadership roles in education, the criteria include:

        • Holding an advanced degree (e.g., PhD, professional doctorate, or master’s).
        • Demonstrating improvements in your institution’s rating, maintaining a “Good” or higher rating.
        • Contributions to research, student success, and community initiatives.

Eligibility Criteria for Teachers and Faculty Members

        • Teachers and faculty members need to meet the following:
        • Holding advanced degrees or relevant qualifications.
        • Demonstrating professional excellence through student success and positive feedback.
        • Contributing to research and supporting key student groups, such as Emirati students and students of determination.
        • Receiving national or international recognition through awards.

        Required documents

To support your application, you may need to submit:

KHDA school rating reports (for principals).

        Award certificates and research publications.

Testimonials from students, parents, and staff.

Evidence of community involvement and improved student outcomes.

Recommendation letters from the board of governors.

        When can you apply?

The application process opens on October 15, 2024, with schools and universities able to nominate eligible educators. Nominations will be accepted from mid-October until mid-December each year, providing a window for teachers and academic leaders to apply.

By following these steps and ensuring that you meet the eligibility criteria, you can secure the prestigious Golden Visa and enjoy the benefits of long-term residency in Dubai.

Have you registered to vote for the 2025 Philippine National Elections? If so, as a registered Overseas Filipino Worker (OFW), you have the opportunity to make your voice heard by participating in the election and casting your vote for key national positions. The voting period will run from April 13 to May 12, 2025, giving you a full month to choose your candidates.

For this election, OFWs can vote in two specific categories: Senators and Party-List Representatives, ensuring representation for Filipinos abroad in shaping the future of the country.

This privilege for overseas Filipinos is based on Republic Act No. 9189, as amended by Republic Act No. 10590, which allows Filipinos abroad to cast their ballots in national elections. Although new voter registration closed on September 30, 2024, those who are already registered as overseas voters will be able to participate in the 2025 elections.

A notable change for the 2025 elections is the adoption of internet voting, which is expected to significantly increase voter accessibility and turnout. The Commission on Elections (COMELEC) has expressed optimism that this innovation will allow more overseas voters to participate easily, without needing to visit embassies or consulates. According to reports, a successful internet voting test was conducted in 2023, paving the way for this method to be implemented in 2025

COMELEC also shared that the convenience of internet voting is particularly vital for OFWs who are spread across different time zones and remote locations, allowing them to participate without any logistical challenges. This modernization is aimed at enhancing democratic participation among Filipinos living abroad.

If you’re a registered overseas voter, make sure your registration is still active and stay tuned for specific instructions from your local Philippine consulate or embassy regarding the voting process. Internet voting instructions and other election-related updates will be provided through official channels leading up to the election.

For those based in the UAE, here are the details of the nearest Philippine diplomatic offices:

Philippine Consulate General in Dubai: Villa No. 234-851, Beirut Street, Al Qusais 3, Dubai, UAE.

Philippine Embassy in Abu Dhabi: Embassy of the Republic of the Philippines, Al Bateen, Street No. 8, Villa No. 8, Abu Dhabi, UAE.

        • Manila Areas: Cut-off on or before October 10, 2024 (Estimated delivery by December 20, 2024)
        • Luzon Areas (except inter-islands): Cut-off on or before October 5, 2024 (Estimated delivery by December 20, 2024)
        • Visayas, Mindanao, & Luzon Inter-Islands: Cut-off on or before September 10, 2024 (Estimated delivery by December 20, 2024)
          Prohibited Items in Balikbayan Boxes

When sending balikbayan boxes, it’s essential to avoid including prohibited items such as illegal drugs, firearms, flammable materials, pornographic content, counterfeit goods, pirated media, endangered species, perishable foods, excessive alcohol and tobacco, and large amounts of undeclared currency. Adhering to these guidelines helps prevent legal issues and ensures the safe arrival of your boxes.

Dos and don’ts when sending balikbayan boxes

Dos: Check the list of prohibited items, pack your items securely, label your box clearly, declare the value of your items, keep an inventory, seal your box properly, and use reputable shipping companies.

Don’ts: Avoid overpacking your box, sending prohibited items, including excessive quantities of certain goods, shipping expired food products, using unmarked boxes, including sharp objects without proper packing, and mixing perishable with non-perishable items.

Did you know that residents and investors in the UAE can now file complaints against unwanted cold calls? New regulations, effective from August 27, 2024, allow the public to report telemarketers who violate the rules set by the UAE government, Khaleej Times reported.

Under these regulations, if you receive an unsolicited call, you can report it to the appropriate authority. For instance, calls related to banking should be reported to the Central Bank, while those concerning investments should go to the Securities and Commodities Authority (SCA). If the caller uses a personal mobile number for marketing purposes, the complaint should be directed to the Telecommunications and Digital Government Regulatory Authority (TDRA). “If someone is using their personal mobile number to call you to market their goods, then you have to report to TDRA,” explained Mohammad Al Ramsi, deputy director-general of the telecommunications sector at TDRA.

To make it easier, you can report violators using a simple SMS. Just type “REPORT” followed by the phone number (e.g., “REPORT 05XXXXXXX”) and send it to 1012.

The new rules also restrict telemarketers from calling outside the hours of 9 am to 6 pm and prevent them from calling the same person multiple times a day. Companies must obtain prior approval for telemarketing activities and provide comprehensive training to their marketers. Failure to comply with these regulations can result in fines ranging from AED 5,000 to AED 150,000, depending on the violation’s nature and frequency.

Khalid Al Mahmoud, director of the Licensing Department at the SCA, encouraged consumers to report unsolicited calls directly on the SCA’s website or via email. “Penalties will be applied if there is a breach of the law,” he said.

These measures are part of the UAE’s efforts to protect consumer privacy and reduce the nuisance of cold calls. The Ministry of Economy is also overseeing the “do-not-call registry” (DNCR), a tool to ensure that residents who opt out do not receive telemarketing calls. Safeya Hashem Al Safi, acting assistant undersecretary for the commercial control and governance sector at the Ministry of Economy, emphasized, “We aim to prevent bothersome marketing calls and ensure companies follow proper guidelines.”

So, if you’re tired of receiving cold calls, know that the UAE government has put in place clear steps to help protect your privacy and peace of mind.
